Background:
A financial business analyst was arrested on suspicion of sexual communication with a child and causing a child to watch a pornographic act. Police alleged that he had contacted a 14-year-old boy via Snapchat, sent a sexual video of himself, and requested indecent images in return. In this particular case, the "child" was an undercover police operative. The Police attended his home after receiving intelligence from his internet service provider that he was the person using the snapchat account.
Defence Strategy:
At the police station, our client exercised his right to silence, ensuring the burden remained on the police to prove the allegation. We advised against offering explanations at this stage, preventing the risk of inadvertently strengthening the case against him. Throughout the investigation, we closely reviewed the evidence and pressed the police to properly substantiate their claims.
The Outcome:
Following a digital forensic examination, the police were unable to attribute the Snapchat account or email address to our client. With no reliable evidence connecting him to the communications, the case was closed, and no further action was taken.
Wider Issues in Sexual Communication Investigations
This case highlights a wider reality: it is not uncommon for undercover police operatives to pose as children online in order to identify potential offenders. Digital communications are a normal part of daily life, but they are also heavily monitored in these investigations.
For anyone engaging in adult conversations online, the moment a person claims to be under 18, the only safe course of action is to end communication immediately. Continuing the discussion risks prosecution, reputational harm, and lasting personal consequences.
